What Labor Laws Apply To 15-Year-Olds Or Less?

If you must get a job as a 15-year-old, it is important that you know the federal laws that apply to you. The Fair Labor Standards Act (FLSA) under the US Department of Labor (DOL) has designed these laws to protect you from child labor.

The law sets wages, hours worked, and safety requirements for minors (individuals under age 18) working in jobs covered by the department.

According to FLSA the minimum age of employment is 14 years old for jobs that do not involve agricultural work or machine-moving skills. The FLSA also forbids the employment of minors in jobs that are declared hazardous by the department.

Although these are federal laws, each state still has its own rules on employment for minors. In a case where there is a clash of both the FLSA law and the state law, the law that best protects the child is used.

How Many Hours Can A 15-Year-Old Or Less Work?

The FLSA includes the minimum number of working hours for minors under the age of 16. This law states that “youths 14 and 15 years old may work outside school hours in various non-manufacturing, non-mining, non-hazardous jobs under certain conditions.”

Hence, the permissible working hours for minors under the age of 16 as directed by FLSA are:

  • 3 hours on a school day;
  • 18 hours in a school week;
  • Non-school hours
  • 8 hours on a non-school day;
  • 40 hours in a non-school week; and
  • Between 7 a.m. and 7 p.m., except from June 1 through Labor Day, when nighttime work hours are extended to 9 p.m.

When you get to 16, some of these laws won’t be applicable to you.

Having known this, let’s see how much you can earn as a 15-year-old.

How Much Can 15-Year-Olds Or Less Earn?

The standard minimum wage set by The Fair Labor Standards Act (FLSA) is $7.25 per hour and all states adhere to this rule.

However, for employees less than 20 years of age, the minimum wage set by The Fair Labor Standards Act (FLSA) is $4.25 per hour during their first 90 consecutive calendar days of employment with an employer.

When the employee gets to 20 years of age or after 90 days of employment, the worker must receive the minimum wage. This is not limited to your first employer. Anytime you change employers while still under the age of 20, you receive the minimum wage- $4.25 per hour.

Some states have their own minimum wage laws different from FLSA and in some cases higher. So just like in working hours, when the FLSA laws and the state laws overlap, the higher standard applies.

Note: Certain full-time students, student learners, apprentices, and workers with disabilities may be paid less than the minimum wage under special certificates from the Secretary of Labor. This is commonly referred to as the sub-minimum wage.

Now you know how much you can earn as a 15-year-old, it’s just right to know the places that hire 15-year-olds. This leads us to our next discussion.
